问：

我公司有一个买卖合同案件，已在海南某基层法院申请执行，被执行人在当地无财产可供执行，我们了解到被执行人的法定代表人住在北京，请问该案能否委托北京的基层法院执行？

答：

《最高人民法院关于委托执行若干问题的规定》明确了委托执行的条件为“执行法院经调查发现被执行人在本辖区内已无财产可供执行，且在其他省、自治区、直辖市内有可供执行财产”。只有具备了上述条件，才能委托执行。

被执行人在海南无财产可供执行，被执行人的法定代表人住在北京，仅这这两个条件尚不具备委托执行的条件，只有被执行人在北京有可供执行的财产，才能由海南某基层法院委托北京的基层法院执行。
