（1）1年仲裁时效
（2）例外：劳动关系存续期间因拖欠劳动报酬发生争议的，劳动者申请仲裁不受1年仲裁时效期间的限制；但是，劳动关系终止的，应当自劳动关系终止之日起1年内提出
（3）注意：单位因超过1个月未与劳动者签订书面劳动合同，所应支付的双倍工资，其中超过正常工资部分，不属于“劳动关系存续期间拖欠劳动报酬”，受到仲裁时效的限制。
在劳动者主张双倍工资时，因未签订合同行为处以持续状态，故时效可从其主张权利之日起向前计算1年。
